Introduction:
All human beings are born free and equal in dignity and rights. They are endowed with<br /> reason and conscience and should act towards one another in a spirit of brotherhood.<br /> All are equal before the law and are entitled without any discrimination to equal<br /> protection of the law.<br /> <br /> But what do the two words so often spoken by all people, Law and employees actually<br /> mean?<br /> <br /> Law, is a set of mandatory provisions that emanate from legislative power and is the<br /> formula that sets a fixed, constant and measurable relation between human situations.<br /> As for the word employees: they are those who, on the basis of filling a vacancy in the<br /> staff, exercise their activity in the central and local bodies of State Apparatus, as stated<br /> in Chapter II, Article 7 on the role of employees in Mozambique.<br /> <br /> The people that work for the state are called public servants and are organized into<br /> different frameworks. For example, the Mozambique state is organised under the<br /> following framework:<br /> <div style="margin-left: 40px;">General Framework, which is subdivided into: Common Framework; Private<br /> Framework.<br /> Provincial framework, which is subdivided into: Common Framework and Sectored<br /> Framework.</div> <br /> We must also mention to those of you reading this introduction to make you aware that<br /> in most states in the world the principles of legality in State government exist and<br /> require the strict and uncompromising observance of legal rules at all levels of its<br /> apparatus, including within institutions and organizations, by all employees and<br /> citizens. It is for this reason and many others that all employees must follow the law.<br /> Notwithstanding the fact that public servants have duties, for example, in Mozambique<br /> in article 98 of chapter VII of section I of the EGFE, various obligations were laid<br /> down in relation to state employees in Mozambique and in one of them it says:<br /> <br /> <em>“Dedicate yourself to study and apply the law and other decisions of State-governed<br /> bodies”. Furthermore, in article 99, there are special duties for state employees, where<br /> it is stated: “present yourself punctually, correctly and with poise in all places where<br /> you are engaged in work.”</em><br /> <br /> As you can see, working for the state in any country does not only imply financial<br /> stability. Of course, anybody working in this condition has rights. A practical example<br /> from Mozambique is in article 103, where the rights of State Apparatus employees are<br /> described: <em>“receive legally established salary, have a daily break to eat and rest, be<br /> treated fairly and with respect.”</em><br /> <br /> As we have said until now, we cannot forget that teachers are state employees and are<br /> subject to the legislation contained in the General Statute for State employees. The<br /> current statute applies to all faculty staff who exclusively perform the task of educating<br /> and training within educational institutions or in courses officially recognised by the<br /> Mozambique Ministry of Education.<br /> <br /> As such, teachers are subject to duties and rights. Some of their duties are: to defend<br /> the legal order established by the state, to educate their students for the love of the<br /> people, in dedication to the homeland and in respect for the work, and to develop a<br /> patriotic conscience in students. And with that we should highlight some of their rights:<br /> to be integrated into an occupational category according to that defined in the Statute<br /> and to progress to higher categories; be protected by security measures under the Law.<br /> Hence, with this task you have the opportunity to learn more about the Law that<br /> governs the employees of your country, since you yourself are part of this system.

1. Speed-read the law and take notes (F1) at parts of special<br /> interest (get it from de headmasters of primary schools –<br /> read the file).<br /> <br /> 2. Pay special attention to obligations and demands to the<br /> teacher.<br /> <br /> 3. Answer the question “Which acts from the teacher’s side<br /> bring about expulsion from the state”.<br /> <br /> 4. Make a summary report for your own future use.<br /> <br /> 5. Send the summary report to your teacher for comments.
